Abstract

In the first years of the installation of the Panamanian criminal process, one of the most used conflict resolution procedures was that of Conditional Suspension. The Guarantee Judges ruled in most cases, suspending the process subject to conditions. The guarantee judges have records of the procedures for alternative solutions to Criminal Conflicts, which will be applied to the defendant in accordance with what is specified in the regulation and must guarantee monitoring and control of these. For a better understanding of the subject, the effectiveness of alternative conflict resolution procedures in criminal proceedings in the Accusatory Penal System of Santiago - Veraguas will be analyzed. Alternative procedures are a necessary instrument to speed up the flow of cases within the system. In order for the parties to benefit, each agreement will be appropriate to the type of crime or offense committed by the accused. These procedures are an essential tool to facilitate the flow of cases in the criminal prosecution system, facilitate an early exit from the mobile for the benefit of all interested parties, based on this, a quantitative methodology is selected in order to obtain accurate data. With respect to this topic and its variables, the design is descriptive - not experimental, which allowed the application of the survey evaluation instrument to the staff of the Santiago Veraguas Accusatory Penal System, this left as a conclusion that alternative conflict resolution procedures They are efficient when it comes to reducing the time in criminal proceedings, since they point out that the main benefit is that it reduces the time to resolve the conflict.
