Abstract
This article deals with the rights of same-sex couples before the decision of the Supreme Court of Justice not to recognize equal marriage in Panama. The objectives are: 1) To identify from the voices of the key informants their position on the decision issued by the Supreme Court of Justice in Panama on March 1, 2023 on the non-recognition of equal marriage. 2) To know the rights that attend the civil union of persons of the same sex based on comparative law in other countries. 3) To interpret through comparative law the local and international reactions to the decision of the Supreme Court of Justice not to recognize equal marriage in Panama. As a frame of reference, the work of Navarro (2019) is cited, entitled: Marriage of same-sex couples and its effectiveness in the Legal System of the Republic of Costa Rica, which contravenes the decision of the Supreme Court of Justice of Panama (2023), which rejected the recognition of equal marriage, for not considering it a human right recognized by the Panamanian Constitution. It also stated in the ruling published on March 1, 2023 that "There is a reality, and that is that, so far, the right to equal marriage is no more than an aspiration that, although legitimate for the groups involved, does not have the status of a human right or even a fundamental right" (p.1). Methodologically, the study is approached from the interpretative paradigm, qualitative approach, phenomenological method and grounded theory design.
