Abstract

This research paper analyzes arbitration as a means of dispute resolution, which may be national or international, in law or in equity, ad-hoc or institutionalized. It studies whether it detracts from the traditional judicial system or complements it. Using as research methodology the analysis of jurisprudential cases and literature review. The conclusion is that arbitration as a special jurisdiction constitutes an exception to the monopoly of the state administration of justice, by offering an alternative for the resolution of conflicts and this can be useful when speed, specialization or confidentiality are valued.
