La prueba en el proceso civil

Abstract

Our research topic is evidence in civil proceedings: what types exist, how they are used in different processes within the civil sphere, and their application, as well as their evaluation by judges when issuing a verdict or resolving cases. This article aimed to analyze the importance, legal framework, procedure, and types of evidence within the civil process, examining each of its methods and using as examples cases that reached the evidentiary stage. The most relevant findings of this research indicate that evidence, according to its type, is established in ways that are useful for the different types of processes in the civil sphere. Evidence is the fundamental pillar within the process, as without the proper volume of evidence or submitting it late, even when one may have “the right” within the process, it will not be taken into account by the judge’s discretion due to non-compliance with the time limits set in the procedural rules of our country.
